Leafly Affiliate Marketing Terms
These terms contain important information regarding your rights and obligations, as well as conditions, limitations, and exclusions that apply to you.
Eligible customers may place affiliate marketing placements with affiliate links within certain Leafly Content (“Affiliate Marketing”). All Affiliate Marketing placements shall be subject to these terms (“Leafly Affiliate Marketing Terms”), the website Terms of Use located at Leafly.com, the Leafly Master Services Agreement, and any other agreements entered into between you and Leafly.
Capitalized terms used but not defined herein have the meaning set forth in the Leafly Master Services Agreement available at https://www.leafly.ca/info/us-brands-msa for US customers, and at https://www.leafly.ca/info/canada-brands-msa for Canada customers.
Affiliate Link(s)
- Company must provide and maintain functional affiliate link(s) that lead to a webpage displaying the Company product or service specified on the Service Order (“Affiliate Link”). In the event that the webpage changes, or Company ceases to offer the product(s) or service(s), Company shall inform Leafly immediately.
- Company must utilize a third party affiliate tracking software that uses cookies to track website visitors that originate from the Affiliate Link (“Affiliate Platform”). Company agrees to provide Leafly with access to the Affiliate Platform.
- Leafly will publish the Affiliate Link within the Leafly Content indicated on the Service Order, and Leafly may publish the Affiliate Link throughout the Leafly Platform where Company’s products may be mentioned or promoted.
Commission
- Company agrees to pay Leafly a percentage commission of all revenue from sales made via referral from the Affiliate Link. The actual rate of commission shall be stated on the Service Order, and based on the revenue totals reported by the Affiliate Platform.
- Sales made via referral from the Affiliate Link and total revenues that give rise to commission under the Leafly Affiliate Marketing Terms shall be determined by the Affiliate Platform reporting and shall not be auditable by Leafly. Company and Leafly agree that the total revenues generated by Affiliate Marketing shall be determined solely by the Affiliate Platform reporting and both Parties agree that neither party may dispute or contest the validity or accuracy of the revenues reported.
- Commissions will be calculated every 30 days. Commissions shall be invoiced and paid according to the Leafly Master Services Agreement.
Restrictions
- Company shall not modify the Affiliate Link destination without providing 10 days prior notice to Leafly. Leafly reserves the right to remove any Affiliate Link in the event that Leafly determines that an Affiliate Link destination does not align with any Affiliate Link placements available on the Leafly platform.
- Company shall not directly or indirectly utilize any technology, software, or service that prevents the Affiliate Platform from determining the actual number of sales and revenue made via referral from the Affiliate Link.
